The ecological environment departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government, and the Xinjiang Production and Construction Corps Ecological Environment Bureau:
Small and micro enterprises are the new force in the development of the national economy. They play an important role in expanding employment, stabilizing growth, promoting innovation, prospering the market, and meeting the needs of the people. They are related to the overall situation of people's livelihood and social stability. At the same time, small and micro enterprises have the characteristics of small scale, few personnel, simple process flow, small environmental impact of some small and micro enterprises, and relatively weak environmental protection capabilities. They have general expectations for deepening the environmental impact assessment reform and optimizing the environmental impact assessment service. In order to implement the decision and deployment of the Party Central Committee and the State Council, do a good job in the "six stability", implement the "six guarantees" task, further optimize the business environment, stimulate the vitality of small and micro enterprises, and promote green development, these opinions are formulated.
1. Deepen reforms and simplify the environmental impact assessment management of small and micro enterprise projects
(1) Reduce the scope of project environmental assessment
By revising the "List of Classification Management for Environmental Impact Assessment of Construction Projects" (hereinafter referred to as "List"), projects with less environmental impact will further reduce the number of environmental assessment approvals and filings. Construction projects not specified in the "List" shall not be included in the EIA management in principle. Strengthen the connection between environmental impact assessment and pollutant discharge permits, and no longer fill in environmental impact registration forms for construction projects that implement pollutant discharge permit registration management. Some industries that have a small impact on the environment only include new renovation and expansion projects in industrial buildings into EIA management. The relevant requirements will be implemented after the new "List" is released and implemented.
(2) Simplify the preparation of the report form
For construction projects that have certain environmental impacts and need to prepare an environmental impact report form (hereinafter referred to as the report form), the format of the report form is revised, the content of the form and the filling requirements are simplified, and the difficulty of preparation is reduced. Study on simplification of report form project evaluation procedures and evaluation content; focus on quoting existing data to simplify the analysis of environmental quality status; for special evaluations, highlight key elements or topics; for special evaluations, no model is required To forecast, just fill in the form as required.
(3) Exploring the simplified model of EIA for similar projects
Strengthen the linkage between the planning and project environmental assessment of industrial parks (including industrial clusters, industrial clusters, etc.). For small and micro enterprises that are located in the park that has completed the planning and implementation of the environmental impact assessment and meets the relevant ecological environment access requirements, the project environmental assessment can directly quote the planning environmental assessment conclusions to simplify the environmental assessment content. Explore the same type of small and micro enterprise projects in the park to carry out environmental assessment and approval, and put forward pollution prevention and control requirements uniformly, and no repeated environmental assessment for individual projects. Encourage localities to explore environmental governance models such as "green islands", build environmental protection public infrastructure or centralized process facilities (such as electroplating, printing and dyeing, spraying, etc.) shared by small and micro enterprises, clarify a responsible subject, and carry out environmental assessments of shared facilities in accordance with the law. Companies that rely on related facilities do not need to consider the content of the supporting facilities for their project EIA category determination.
(4) Continue to advance the reform of the positive list of EIA approval
Continue to promote the reform of the positive list of EIA approval, and the relevant provisions of the current positive list will continue to be implemented before the new "List" is released and implemented. Encourage local eco-environmental departments to refine the implementation requirements of the positive list of EIA approval based on the actual situation of local small and micro enterprises and on the basis of the evaluation of the effectiveness of the previous reform pilots. Small and micro enterprise projects that have clarified regional ecological and environmental protection requirements and formulated ecological environment access conditions for related industries can be included in the notification and commitment approval trial.
2. Improve services and help small and micro enterprises to do a good job in environmental assessment
(5) Strengthen environmental assessment consulting services
Eco-environmental departments and administrative approval departments at all levels should further enhance their awareness of active service to small and micro enterprises, send policies and technologies to enterprises, and unblock consulting service channels through official websites, WeChat official accounts, government service windows, hotlines, etc. , Publicize the positive list of local environmental assessment approvals and the access conditions for the ecological environment, provide environmental assessment consulting for small and micro enterprises, and avoid small and micro enterprises from "going wrong" and "spending money". Encourage the grassroots and parks to widely use new media, publicity boards, and use cartoon animations, short videos, "one picture to understand", brochures and other easy-to-understand forms to strengthen EIA knowledge publicity, help small and micro enterprises accurately understand EIA management requirements, and guide Small and micro enterprises are building and operating in compliance with laws and regulations.
(6) Facilitate the selection of EIA units
Eco-environmental departments and administrative approval departments at all levels should actively publicize and promote the national environmental assessment credit platform, regularly disclose the information of relevant environmental assessment units, and encourage small and micro enterprises to choose the best ones with good credit and strong technical capabilities. Any unit or individual in the ecological environment department and administrative approval department at all levels shall not designate an environmental assessment unit to the enterprise in any way.
(7) Advancing the standardization of environmental assessment fees
The environmental impact assessment unit shall abide by the clearly marked price regulations, actively inform the construction unit of the content of the environmental impact assessment service and charging standards, clarify the boundary between the environmental assessment and other environmental consulting, environmental protection investment, etc., and stipulate in the relevant service contract that no unmarked fees shall be charged. Do not collude with each other to manipulate market prices. Encourage industry associations to carry out initiatives to regulate environmental impact assessment fees and guide the orderly competition and healthy development of the environmental impact assessment market.
(8) Carry out policy and technical assistance
Research and promote online technical assessment and consulting services, build a service team with national and provincial technical assessment units and related experts as the main body, and provide remote guidance and assistance to grassroots environmental assessment and approval departments and small and micro enterprises. Grassroots ecological and environmental departments and administrative approval departments can entrust provincial and municipal technical assessment units to conduct technical assessments on projects with relatively complex processes, environmental impacts or environmental risks, improve the quality of environmental assessment and approval, and put forward reasonable and feasible environmental protection requirements for small and micro enterprise projects .
3. Strengthen supervision to ensure that environmental protection requirements of small and micro enterprises are not lowered
(9) Strict project environmental access
Encourage localities to combine regional "three lines and one order", planning environmental impact assessment and other related requirements to formulate ecological environment access conditions for special industries where small and micro enterprises are concentrated, clarify ecological environmental protection requirements, and support the development of green, low-carbon small and micro enterprises. For projects that do not meet the access requirements, environmental assessment procedures are not allowed in accordance with the law, and construction is strictly prohibited. Strictly review and control chemical, pharmaceutical, smelting, coking, and hazardous and heavy industries. All localities should increase the investigation and rectification of "scattered and polluted" enterprises, and promote the victory of the fight against pollution.
(10) Compact corporate environmental responsibility
Small and micro enterprises included in the EIA management should complete the procedures in accordance with the law and implement the relevant ecological environment
Environmental protection measures belong to the project that the environmental impact assessment informs the promise to approve the reform pilot project, and the promises should be strictly fulfilled. Small and micro enterprise projects that are not included in environmental assessment management should earnestly implement relevant laws, regulations and environmental protection requirements, and accept environmental supervision in accordance with the law.
(11) Flexible environmental supervision
Encourage local ecological environment departments to innovate in ecological environment law enforcement methods, optimize daily supervision of "double random, one open", and flexibly use "online + offline" methods to conduct spot checks to fully protect the legitimate rights and interests of small and micro enterprises. For small and micro enterprises with low pollutant discharge, low environmental risk, and advanced production technology, they can be included in the positive list of supervision and law enforcement according to procedures, reducing the number of law enforcement inspections or avoiding on-site inspections. Standardize the exercise of discretion in administrative penalties, exempt or mitigate penalties for small and micro enterprises that meet the conditions for exemption or mitigation of penalties, and strengthen guidance and assistance for environmental protection rectification of enterprises.
4. Strengthen guarantees and promote the implementation of small and micro enterprise reform measures
(12) Improve environmental protection infrastructure
Local ecological environment departments should actively promote local governments, relevant departments, parks, etc. to improve sewage treatment facilities, solid waste disposal facilities and environmental emergency protection systems, improve environmental risk prevention and control measures, and reduce the difficulty of environmental assessment and operating costs of small and micro enterprise projects.
(13) Promote the sharing of monitoring data
Local ecological environment departments should promote the disclosure of data on routine environmental monitoring and law enforcement monitoring. Encourage the park to make overall arrangements for environmental monitoring, monitoring network construction, and to carry out monitoring of environmental factors such as the atmosphere, surface water, groundwater, and soil in combination with the main pollutants of the project entering the park. Public monitoring data can be directly quoted in the environmental impact assessment of related projects to reduce the cost of environmental assessment.
(14) Encourage public supervision
Local ecological and environmental departments should publicly report telephone calls to the public, focusing on small and micro enterprise projects such as illegal charges, illegal handling, and non-implementation of environmental assessment requirements, strengthen social supervision, and promote the implementation of small and micro enterprise environmental assessment.
(15) Strengthening capacity building
Eco-environmental departments at all levels should strengthen the training and guidance of local EIA practitioners, technical experts, and grassroots EIA approval personnel, and improve the EIA preparation and control capabilities. Promote the construction of informatization and intelligentization of environmental impact assessment, implement the “one network, one network,” and meet the requirements for “no-face” approval as soon as possible, so as to effectively enhance the sense of the reform of environmental impact assessment for small and micro enterprises.
Eco-environmental departments and administrative approval departments at all levels should strengthen organization and implementation, respond to the concerns of the society and small and micro enterprises in a timely manner, summarize experience, find problems, continue to improve, and optimize environmental assessment services for small and micro enterprises. As the work progresses, the provincial eco-environmental department should promptly report the practice experience and typical examples of supporting the development of small and micro enterprises, and the Ministry of Ecology and Environment will promote it.
